ASAASE WURATerms & Conditions
These terms cover Ghana land purchases only. They do not set terms for home sales, rentals, or short stays.
How ASAASE WURA may help
If approved and permitted by law, ASAASE WURA may provide the marketplace and limited coordination services described in the parties’ written agreement. This may include displaying a property listing, passing on a buyer’s question or proposed price, sharing seller-provided documents with a person the seller has authorized, and showing process updates.
ASAASE WURA does not decide for a buyer or seller, accept or reject an offer for them, change their terms, make promises on their behalf, or bind either party unless separate written authority has been reviewed and approved. The buyer and seller remain responsible for agreeing to and signing their own final sale agreement.
A website status or message only reports what the platform recorded. It does not prove that payment cleared, a sale was completed, ownership changed, or a government record was updated.
Price discussions and the proposed commission
The current proposal is one seller-side service commission of 10% of the gross sale price in the buyer’s and seller’s final written sale agreement. Under this proposal, the buyer does not owe ASAASE WURA a commission. A deposit that will be credited toward the sale price is not counted a second time as another commission base.
No commission would be due just because a property is listed, a buyer makes an inquiry, an offer is sent or accepted, or the parties start discussing a sale. The recommended draft position is that any commission would become payable only after the sale is completed under the parties’ final agreement. Before these terms can be used, counsel and the owner must define exactly what “completed” means and how cancellations, payment reversals, rescissions, and disputes are handled.
Any displayed commission or seller-remainder figure is an estimate only. It is calculated once in the agreement’s currency using the site’s current whole-unit display rounding. It does not promise how much money the seller will receive. Taxes, Lands Commission charges, lawyer or surveyor costs, payment-provider charges, and any approved partner charges must be explained separately; they are not silently added to the 10% rate.
The proposed commission is not deducted from purchase money. ASAASE WURA will not hold funds or act as an escrow or custodian under these terms. If a seller is later invoiced separately, the invoice must identify the actual payee and give payment instructions from an approved provider. Any future deduction or split from sale proceeds would require separate legal and provider approval, a written arrangement, and the seller’s clear consent. No such collection or split is active.
Before using the proposed 10% rate, counsel must also confirm whether an Act 1047 fee scale applies and whether the rate, calculation, and collection method comply. Counsel must review any referral fee or commission-sharing arrangement. These terms do not authorize a referral share or commission split.
Stages for a land purchase
- Inquiry and proposed price
A buyer may send a question or proposed price through the agreed channel. Any ASAASE WURA role in receiving or passing on that message must be accurately described and must not go live until the Act 1047 licensing question is resolved.
- Independent checks
The buyer checks the seller’s identity and authority, the land, boundaries, title, and relevant records independently. The seller is responsible for sharing only information and documents they may lawfully share.
- Final written agreement
The buyer and seller—not a website status—put the agreed price, currency, property description, conditions, deposit, payment destination, timing, completion event, and transfer steps in their own definitive sale agreement.
- Payment
The current website does not collect a deposit or purchase payment. If a payment service is approved in the future, its terms must identify the payee and payment destination and explain any applicable safeguarding, timing, refund, and dispute arrangements. A platform status alone is not proof of payment or settlement.
- Commission
If the proposed seller-side commission is approved and legally permitted, the signed seller agreement must explain its calculation, currency, rounding, payment trigger, invoice and payee, and treatment of cancellations, reversals, taxes, and provider fees. The proposed fee is not charged to the buyer and is not deducted from purchase money unless a specific approved legal and provider arrangement allows it and the seller expressly agrees in writing.
- Completion and transfer
The buyer and seller, their professionals, and the relevant payment provider or bank handle payment confirmation, signing, conveyancing, registration, and transfer. ASAASE WURA does not certify title or promise that a website update completes a land transfer.
Payment timing
A previous reference to bank transfers taking “up to three days” is a planning estimate only—not a current service promise. Do not display it as a promise unless the selected provider and receiving institution confirm the payment method, cut-off times, settlement conditions, and whether the period means calendar or business days. Any approved customer wording must explain when timing starts and how delays or reversals are handled. A provider’s merchant settlement time is not necessarily the buyer’s payment-confirmation time or a release time for escrowed funds.
Buyer and seller agreement wording
The buyer and seller make their own decisions and remain responsible for their sale agreement. If both parties authorize ASAASE WURA to relay a proposed price or response, the platform may pass on only the communications and process updates described in the approved written mandate. ASAASE WURA cannot accept, reject, or change an offer for either party, and cannot make a promise or waive a right on their behalf.
Before signing, the parties should record the final price and currency, property details, conditions, deposit, payment destination, completion requirements, timing, and transfer steps in their definitive written agreement. Each party should obtain independent professional advice and verify the relevant property information and public records. A price agreement or recorded check is not a deed transfer, title confirmation, payment confirmation, or completed sale.
